Lt. Breakey was court-martialed in November 1862 at Nashville for “absenting himself from his company and regiment without leave of absence from his commanding officers.” This occurred near Tantalon, Tennessee on August 6, 1862, Breakey returning on August 12, 1862. The court found him guilty and sentenced that he be reprimanded before the entire regiment by Colonel Hull. The court gave him a light sentence “owing to the very good character of the accused as an officer.” His absence is noted in the three communications from the OR:

The trestle about a mile above Tantalon must be guarded. It is reported that Lieutenant Breakey, Company I, at Tantalon, has gone off without leave and that his wife was in camp with him. Inspect and report facts in this case. It is said that some of your men straggle from their posts; if so, you must have it stopped, as we are dependent upon their vigilance.
